Roefe, Marlon M Aty
In addition to my law practice, since 2013, I have had the privilege and honour of sitting as Deputy Judge of the Ontario Superior Court of Justice for the Small Claims Courts in Burlington, Milton and on occasion, in Brampton. From collections to contract disputes, from injunctions to tribunals, these complex matters should always be handled by a professional.

Choose Marlon to help you navigate through the legal issues at hand. With experience comes confidence. For over 40 years Marlon has seen it all. Your sensitive legal matters should always be handled by someone who knows the ropes and will look out for you or your company's best interests. When it comes to sensitive legal issues, experience goes along way.
Services
I'm a sole practitioner. That means this is my law practice. I am responsible for the service provided to my clients directly and provided with the assistance of my supervised, mentored, personally trained and experienced assistants. I've been in practice since 1981.

The enthusiasm to provide the best service for my clients which I had when I was called to the bar on that fateful day in April of 1981, matured and developed to the profound core value of my practice. The matters entrusted to me are serious matters and I provide my clients with my best service, counsel and advocacy, always.
Litigation is the process of seeking a remedy for a matter in dispute by a judge. This process culminates with the trial, where the judge after considering the admissible evidence, and applying the law as the judge may understand it, determines what happened, and what relief, if any is to be granted.
Estate litigation frequently consists of disputes over property, money, income streams and the control and entitlement to that property, monies or income stream. An estate may be established by a Will, a grant of Power of Attorney over property, a Trust deed or otherwise.

An estate may be rife with opportunities of conflict between the trustees, who hold the property for the purposes as may be set out in the document which created the trust for the beneficiaries, and the beneficiaries of the trust whose entitlements may include income streams, specific or general property interests or whose rights may be limited by the discretion of the trustees.
Arbitration and mediation are private processes. As a private process, the parties can tailor the process to suit their needs, their budget and the complexity of the matters at issue. It is one of the few forums in which the parties may judge shop.

Mediation is a process where the parties strive to consensually resolve their dispute with the assistance of the mediator, who assists the parties in coming to resolution and dealing with the underlying issues in the dispute. It is an excellent process where the parties have or expect to have ongoing dealings with each other.
Injunctions may be viewed as the apex of the court's jurisdiction and power. Within the context of commercial fraud, where there is a genuine risk of destruction of records or movement of assets beyond the reach of the court, Orders may be obtained on little or no notice.

Such Orders may direct a recipient of the Order to permit entry to their business or residence and consent to the search of their records, to direct a bank to disgorge its records of a customer to trace monies before the alleged fraudster is aware of the litigation, or to seize assets of a debtor before a judgment is obtained. These Orders are not lightly given.
