Which court should I start my case in? If claims will be made for custody of or access to children, you should start the case in the municipality where the children ordinarily live. How do I get a divorce? In order to legally end your marriage, you must apply to the court for a divorce. An application for divorce can only be filed in a Superior Court of Justice or Family Court branch of the Superior Court of Justice.
